19 January 2023 – USACE and the U.S. Coast Guard execute a new MOU on navigable waters of the United States

On 19 January 2023, the U.S. Army Corps of Engineers (Corps) Regulatory Program and the U.S. Coast Guard (Coast Guard) executed a new Memorandum of Understanding on agency reviews of bridge and causeway projects over, in, or affecting navigable waters of the United States.  The Corps and Coast Guard have regulatory authorities that may apply to the review of bridge and causeway projects in such waters.  The MOU applies to coordination between the Corps Regulatory Program, the Corps Section 408 Program, and the Coast Guard Bridge Program.  It does not apply to Corps and Coast Guard coordination on bridge work over navigable waters of the U.S. contemplated by Corps Civil Works Planning studies. The MOU focuses on authorities, jurisdiction, roles and responsibilities, and coordination between the two agencies on the review of bridge and causeway projects over navigable waters of the U.S.
