  • U.S. Army Corps of Engineers announces reissuance of 12 existing Nationwide Permits

    On January 13, 2021, the U.S. Army Corps of Engineers (Corps) published a final rule in the Federal Register (86 FR 2744) announcing the reissuance of 12 existing nationwide permits (NWPs) and four new NWPs, as well as the reissuance of NWP general conditions and definitions with some modifications. These 16 NWPs will go into effect on March 15, 2021, and will expire on March 14, 2026

  • Army Corps of Engineers seeks public comments on proposal to renew and revise nationwide permits

    The U.S. Army Corps of Engineers announced today it is seeking comments on its proposal to renew and revise 52 nationwide permits for work in wetlands and other waters that are regulated by Section 404 of the Clean Water Act and/or Section 10 of the Rivers and Harbors Act of 1899. In addition, USACE is proposing to issue five new nationwide permits that pertain to authorizing seaweed mariculture activities, finfish mariculture activities, electric utility line and telecommunications activities, utility line activities for water and other substances, and water reclamation and reuse facilities.

  • USACE receives new biological opinion on 2012 Nationwide Permits

    3 December 2014 - The U.S. Army Corps of Engineers has received a final biological opinion from National Oceanic and Atmospheric Administration Fisheries on the USACE nationwide permits that were reissued on Feb. 13, 2012, and went into effect on March 19, 2012. The biological opinion was issued on Nov. 24, 2014, and it concludes the re-initiated programmatic consultation on the Endangered Species Act that began in July 2012 between the two agencies.

  • Restoration project may serve as regional prototype

    Nationwide Permit (NWP) 27 specifically authorizes aquatic habitat restoration, establishment and enhancement activities, and it was this general permit, issued by Linda Elligott, project manager in the Fort Myers Regulatory Office, that authorized a unique hydrologic and habitat restoration project in Charlotte County.

    Early in December 2012, Regulatory Division’s Antilles Office staff received word that the island of St. Thomas in the U.S. Virgin Islands was on the brink of losing electrical power, absent a permit to make necessary modifications to a dock at Krum Bay which would facilitate the delivery of fuel.

  • Corps’ New England District suspends nationwide

    The U.S. Army Corps of Engineers (USACE) has reissued its Nationwide Permits (NWPs), authorizing work in streams, wetlands and other waters of the United States under Section 404 of the Clean Water Act and Section 10 of the Rivers and Harbors Act of 1899. The new NWPs took effect March 19, 2012 replacing the existing 2007 NWPs.
