  • 12 March 2025 - WOTUS UPDATE: Joint Agency Memorandum on Continuous Surface Connection and EPA Announcement on Next Steps for WOTUS

    This morning, EPA Administrator Lee Zeldin announced next steps to revise the definition of “waters of the United States” (WOTUS) under the Clean Water Act to fully align with the Supreme Court’s direction in Sackett v. EPA. The agency will work with the United States Army Corps of Engineers to ensure that a revised definition follows the law, reduces red-tape, cuts overall permitting costs, and lowers the cost of doing business in communities across the country while protecting the nation’s navigable waters from pollution.
  • 18 January 2023 - Final Revised Definition of "Waters of the United States"

    On December 30, 2022, the U.S. Environmental Protection Agency (EPA) and the U.S. Department of the Army (the agencies) announced the final "Revised Definition of 'Waters of the United States'" rule. On January 18, 2023, the rule was published in the Federal Register; the rule will be effective on March 20, 2023.
