Corps permits are also necessary for any work, including construction and dredging, in the Nation's navigable waters. The Corps balances the reasonably foreseeable benefits and detriments of proposed projects, and makes permit decisions that recognize the essential values of the Nation's aquatic ecosystems to the general public, as well as the property rights of private citizens who want to use their land. During the permit process, the Corps considers the views of other Federal, state and local agencies, interest groups, and the general public. The results of this careful public interest review are fair and equitable decisions that allow reasonable use of private property, infrastructure development, and growth of the economy, while offsetting the authorized impacts to the waters of the US. The adverse impacts to the aquatic environment are offset by mitigation requirements, which may include restoring, enhancing, creating and preserving aquatic functions and values. The Corps strives to make its permit decisions in a timely manner that minimizes impacts to the regulated public. 

Regulatory Request System

The USACE Regulatory Program launched a new national online application portal and management platform called the Regulatory Request System (RRS).  RRS allows users to apply for individual and general permits using online forms and is available at https://rrs.usace.army.mil/rrs.  Applicants are still able to apply for permits by traditional mail or emailing electronic submittals to the appropriate regulatory office using the Individual Permit Application Form and the Nationwide Permit Pre-construction Application Form available on this page.  Applicants should continue to use existing processes in districts that have a joint permit application with federal and state agency partners or other local processes that are not yet available in RRS.  A list of districts with joint permit applications is provided below.  Applicants should contact their respective District offices with questions regarding joint permit applications or other local procedures. 

The Corps is seeking Office of Management and Budget (OMB) review of the forms posted below on this webpage.  Some forms may show as expired and may be modified upon the completion of this review.  Please continue to use the forms posted on this webpage, until further notice.

 Baltimore District (NAB)

Please do not use the RRS to apply for a permit in Pennsylvania, Maryland, the District of Columbia, and certain military installations within northern Virginia (i.e., Fort Belvoir, Fort Myer, and the Pentagon).  The Baltimore District website contains information on how to obtain a Department of the Army authorization and copies of the permit application forms.

 Buffalo District (LRB)

Please do not use RRS to apply for a permit in New York.   The Buffalo and New York Districts employ a joint permit application process with New York State

 Chicago District (LRC)

Please note that the Regional General Permit (RGP) Notification Form for Indiana and the Joint Application Form for Illinois are currently not available in RRS. To submit an Indiana RGP Notification Form or a Joint Application Form for Illinois (e.g., for Shoreline Activities RGP and Lake Michigan RGP applications), please email the completed application materials to ChicagoRequests@usace.army.mil.

 Detroit District (LRE)

The RRS can also be used to apply for a standard permit from the Detroit District for work in the state of Indiana only.  Please note that the Regional General Permit Notification Form for Indiana and the Joint Application Form for Michigan are currently not available in RRS.

Those seeking a permit in the state of Michigan should go to the Michigan Department of Environment, Great Lakes, and Energy website and complete the joint permit application form. Once the application is submitted to the State of Michigan, the State will forward the permit application to the Detroit District via email.

Those seeking a permit in the state of Indiana using the Regional General Permit program or the Nationwide Permit program should go to the Indiana Department of Environmental Management website and complete form 51937 (Wetlands: Section 401 WQC Regional General Permit Notification Form).  Once complete, the form can be submitted to LRE_REG_Michiana@usace.army.mil.  Those seeking a standard permit should utilize the RRS to apply.

 Jacksonville District (SAJ) (Puerto Rico only)

INFORMATION FOR PUERTO RICO APPLICANTS/AGENTS

In Puerto Rico, joint application procedures are in place between the Department of Natural and Environmental Resources (DNER), the Puerto Rico Planning Board (PRPB) and USACE.  The joint application process will now begin by submitting a complete application and attachments through the RRS.  The district will assign an application number and distribute electronic copies of applications to the agencies involved. The assigned USACE number would now be the JPA number.  A local requirements section will be developed in RRS in the future.  For now, additional information will be requested to ensure all agencies have information needed to complete their reviews.  Please visit this link for mor details in the Public Notice on these changes:

 Louisville District (LRL)

In the Louisville District, the Regulatory Request System (RRS) can be used as an option to submit Department of the Army Individual or Nationwide permit application materials to the Louisville District for work within Waters of the U.S.  However, please note that the Indiana Regional General Permit (RGP) Notification Form is currently not available in RRS.  To submit an Indiana RGP Notification Form, please email the completed application materials to CELRL.Door.To.The.Corps@usace.army.mil.

 Mobile District (SAM)

Please do not use RRS to apply for a permit in coastal zone of Mississippi. The Mobile District employs a joint permit application process with the State of Mississippi.  In the coastal zone of Mississippi, applicants should use the joint permit application form.  In addition, applicants in MS should also review the Mississippi General Permits MVK_SAM MSGP to see if their activity qualifies for a programmatic permit through Mississippi Department of Marine Resources (MDMR). The Mobile District website contains more information on how to obtain a permit and the application form.

 Nashville District (LRN)

Please note, for projects located in the Tennessee River Basin, a Tennessee Valley Authority (TVA) 26a permit may be required, and a DA/TVA Joint Application Form should be completed.  Please be sure to submit the DA/TVA Joint Application Form, and all required supplemental materials to TVA, as necessary.  The Nashville District website contains more information on obtaining a Department of the Army permit and the application form.

 New England District (NAE)

The New England District uses a series of Regional and Programmatic General Permits (GPs) organized by state, in lieu of the Nationwide Permits.  New England District is developing a process to integrate submission of applications for these GPs into the RRS. At this time the RRS should only be used for submission of individual permit applications in Connecticut, Massachusetts, Maine, New Hampshire, Rhode Island, and Vermont.

 New Orleans District (MVN)

Those seeking a wetland permit in the coastal zone of Louisiana should use the joint permit application form

Once information is submitted to the appropriate State agency, the State will send the permit application electronically via email to the correct district.  The New Orleans District website contains more information on obtaining a Department of the Army permit and the joint application form.

 New York District (NAN)

Please do not use RRS to apply for a permit in New York.  The Buffalo and New York Districts employ a joint permit application process with New York State. 

 Norfolk District (NAO)

Please utilize the Joint Permit Application (JPA) for permitting.

 Omaha District (NWO)

If you are planning to do work on or near a waterway in the State of Montana, please use the Montana Joint Application Form.  The Omaha District website contains information on how to obtain a permit and the permit application forms.

 Philadelphia District (NAP)

The Philadelphia District uses State Programmatic General Permits for certain activities in navigable waters in Delaware and southern New Jersey, and for most activities in most waters in eastern Pennsylvania.  At this time, the Regulatory Request System (RRS) should be used for the submission of individual permit applications and nationwide permit preconstruction notifications for activities in non-navigable waters in Delaware and for activities in the Chesapeake and Delaware Canal in Maryland.  All other applications should continue to be directed to the appropriate state agency as is the current practice.

 Pittsburg District (LRP)

Please do not use RRS to apply for a permit in Pennsylvania.  Please continue to submit Water Obstruction and Encroachment Joint Permit Applications to the appropriate Pennsylvania Department of Environmental Protection Regional Office.  The Pittsburg District website contains more information on obtaining a Department of the Army permit and the joint application form.

 Portland District (NWP)

The Portland District partners with State of Oregon agencies to employ a Joint Permit Application (JPA) for permit application submittals. Please contact the Portland District at PortlandPermits@usace.army.mil for application information regarding Columbia River Ports in southwest Washington and restoration projects in the Columbia River estuary funded by the Bonneville Power Administration (BPA), as these projects are evaluated by Portland District.

 Sacramento District (SPK)

In order to apply for the Joint Permit between the U.S Army Corps of Engineers, for Section 404 CWA/Section 10 RHA and the Utah State Engineer's Office, for Section 73-3-29 of the Utah Code, (aka General Permit 10) for impacts to streams within the State of Utah, you must use the Joint Application Form.  This PDF document is an editable form used to apply for a stream alteration permit.  This form can be filed in person at any of the Utah Division of Water Rights offices, mailed to those offices, or submitted online with a credit card payment.  Impacts to other aquatic resources such as wetlands, lakes, ponds, playas, etc. are not eligible for use with General Permit 10.  Impacts to these aquatic resources will require an alternate form of Department of the Army authorization such as a Nationwide Permit, Letter of Permission, or Individual Permit.

 San Francisco District (SPN)

For those seeking dredging permits from the San Francisco District, applicants should use the Consolidated Dredging-Dredged Material Reuse-Disposal Application.  Completed dredging applications can be submitted by email to dll-spn-dmmo@usace.army.mil.

 Seattle District (NWS)

The Regulatory Request System (RRS) may be used to apply for a Section 10 or Section 404 permit within the State of Washington.  As an alternative, you may also use the Joint Aquatic Resource Permit Application (JARPA) to apply for a permit.  The Seattle District partners with local, state, and federal governments to manage the JARPA application form.  The Seattle District website contains links to the JARPA, RRS, and Corps Application forms.

 St. Paul District (MVP)

Please do not use RRS to apply for a permit in Minnesota or Wisconsin.  The St. Paul District employs a joint permit application process with those States.  The St. Paul District website contains more information on how to obtain a permit or to obtain copies of the permit application forms.

 Vicksburg District (MVK)

Those seeking a wetland permit in the coastal zone of Mississippi (MS) should use the joint permit application and notification form. In addition, applicants in MS should also review the Mississippi General Permits “MVK_SAM MSGP” to see if their activity qualifies for a programmatic permit through Mississippi Department of Marine Resources (MDMR).  Those seeking a wetland permit in the coastal zone of Louisiana should utilize the joint permit application form

 Walla Walla District (NWW)

Please do not use RRS to apply for a permit in Idaho.  The Walla Walla District employs a joint permit application process with the State of Idaho. 

 Wilmington District (SAW)

Please do not use RRS to apply for a permit in the Wilmington District, as the state of North Carolina has a joint application process.  The Wilmington District website contains more information on how to obtain a permit and the application form.




 

Regional and Programmatic General Permits

The U.S. Army Corps of Engineers’ (USACE) Regulatory Program involves the regulating of discharges of dredged or fill material into waters of the United States and structures or work in navigable waters of the United States, under section 404 of the Clean Water Act and section 10 of the Rivers and Harbors Act of 1899. A proposed project’s impacts to these areas will determine what permit type is required.

An individual, or standard permit, is issued when projects have more than minimal individual or cumulative impacts, are evaluated using additional environmental criteria, and involve a more comprehensive public interest review.

A general permit is issued for structures, work or discharges that will result in only minimal adverse effects. General permits are issued on a nationwide, regional, or state basis for particular categories of activities. There are three types of general permits – Nationwide Permits, Regional General Permits, and Programmatic General Permits. General permits are usually valid for five years and may be re-authorized by USACE.

Nationwide permits are issued by USACE on a national basis and are designed to streamline Department of the Army authorization of projects such as commercial developments, utility lines, or road improvements that produce minimal impact the nation’s aquatic environment. A regional general permit is issued for a specific geographic area by an individual USACE District. Each regional general permit has specific terms and conditions, all of which must be met for project-specific actions to be verified.

Programmatic general permits are based on an existing state, local, or other federal program and designed to avoid duplication of that program. A State Programmatic General Permit (SPGP) is a type of permit that is issued by USACE and designed to eliminate duplication of effort between USACE districts and state regulatory programs that provide similar protection to aquatic resources. In some states, the SPGP replaces some or all of the USACE nationwide permits, which results in greater efficiency in the overall permitting process.

IMPORTANT NOTE: Most regulatory requests, such as requests for permit actions and requests for jurisdictional determinations, can be completed online through USACE’s Regulatory Request System (RRS). If you intend to submit your regulatory request for a permit action or jurisdictional determination to USACE through the RRS, you do not need to complete the General Regulatory Forms or the Jurisdictional Determination Forms that are linked on this webpage ahead of time. Instead, as you enter information throughout the RRS, that information will be used to populate the forms directly within the RRS system. When you submit your request through the RRS, the forms will be generated automatically and the forms and supporting materials will immediately be sent to the appropriate USACE office to commence evaluation of your request. Note that Aquatic Resources Delineation Forms cannot currently be completed through the RRS.

Even though the General Regulatory Forms and the Jurisdictional Determination Forms on this webpage are not needed to facilitate requests made through the RRS, reviewing the forms on this webpage may help you to understand what information may be needed to facilitate your request.
