    7 January 2026 - U.S. Army Corps of Engineers announces finalization of nationwide permits

    WASHINGTON – The U.S. Army Corps of Engineers announced today that it will reissue 56 existing nationwide permits and issue one new permit for work in wetlands and other waters that are regulated by Section 404 of the Clean Water Act and/or Section 10 of the Rivers and Harbors Act of 1899. One existing permit will not be reissued. "Under President Trump's leadership, the Army Corps of Engineers has taken decisive action to cut bureaucratic red tape and refocus our mission on American prosperity,” said Adam Telle, the Assistant Secretary of the Army for Civil Works. “Ensuring that American citizens and businesses can chase their dreams and build our economy without needless delays is a clear victory for our ability to compete on a global stage during the 21st Century.”

    U.S. Environmental Protection Agency (EPA) Administrator Lee Zeldin, together with Assistant Secretary of the Army for Civil Works Adam Telle, today announced a proposed rule that would establish a clear, durable, common-sense definition of “waters of the United States” (WOTUS) under the Clean Water Act.

    The U.S. Army Corps of Engineers (USACE) is pleased to announce the release of the Antecedent Precipitation Tool (APT), version 3.0. The APT v3.0 expands upon previous functionality by incorporating streamflow data alongside precipitation analysis, providing a more comprehensive description of hydrologic and climatic conditions across the United States and its territories.

    3 July 2025 - USACE seeks public comments on new NEPA implementing procedures for the USACE Regulatory and Section 408 Programs

    The Department of the Army and USACE announce they are seeking comments on an interim final rule that establishes new National Environmental Policy Act (NEPA) implementing regulations at Title 33 Code of Federal Regulations (CFR) part 333 for the USACE Regulatory Program and the USACE Section 408 Program. The interim final rule became effective on July 3, 2025 for Regulatory Program permit applications and Section 408 permission requests submitted to the USACE on or after July 3, 2025.

    On March 12, 2025, EPA and the Army issued joint guidance on how to implement the “continuous surface connection” requirement for adjacent wetlands. The agencies held joint training on the guidance on April 29, 2025.

    Last year the U.S. Army Corps of Engineers introduced its new Regulatory Request System (RRS), an online application portal that allows the public to submit permit applications and other information when requesting permission to dredge, fill or conduct activities in jurisdictional wetlands and waters of the U.S.
