    USACE announced today it is seeking comments on its proposal to renew and revise 56 existing nationwide permits and issue one new nationwide permit authorizing activities associated with improving fish passage.

    16 June 2025 - USACE announces proposal to renew and revise nationwide permits

    USACE announces that it has prepared its proposal to renew and revise 56 of 57 existing nationwide permits for work in wetlands and other waters that are regulated by Section 404 of the Clean Water Act and/or Section 10 of the Rivers and Harbors Act of 1899.

    On March 12, 2025, EPA and the Army issued joint guidance on how to implement the “continuous surface connection” requirement for adjacent wetlands. The agencies held joint training on the guidance on April 29, 2025.

    7 May 2025 - U.S. Army Corps of Engineers encourages use of Regulatory Request System for an improved permitting experience

    Last year the U.S. Army Corps of Engineers introduced its new Regulatory Request System (RRS), an online application portal that allows the public to submit permit applications and other information when requesting permission to dredge, fill or conduct activities in jurisdictional wetlands and waters of the U.S.

    19 March 2025 - Army Corps of Engineers Announces the Release of Updated Wetland Delineation Data Sheets and Updated Automated Wetland Determination Data Sheets (ADS)

    The U.S. Army Corps of Engineers (USACE) announces the release of updated ENG Forms 6116 (1-9), which are the wetland identification data sheets that are used for the ten Regional Supplements to USACE’s 1987 Wetland Delineation Manual. The ENG 6116 series forms received minor updates to 1) extend the Office of Management and Budget (OMB) expiration date and 2) update the soils sections to reflect the updates in the 2024 USDA-NRCS Field Indicators of Hydric Soils in the United States (Version 9.0). In conjunction with the release of the updated ENG 6116 series forms, USACE is also releasing updated versions of the Automated Wetland Determination Data Sheet (ADS), which have been updated to incorporate the updates in 1) the 2024 USDA-NRCS Field Indicators of Hydric Soils in the United States (Version 9.0) and 2) the 2022 National Wetland Plant List. These documents are available at the USACE Regulatory Headquarters Regional Supplements webpage in both Portable Document Format (PDF) and Microsoft Excel (Excel) file formats. The “User Guide for Automated Wetland Determination Data Sheets” is also available at that same location.

    12 March 2025 - EPA and Army Announce Guidance and a "WOTUS Notice: The Final Response to SCOTUS"

    On March 12, 2025, the U.S. Environmental Protection Agency and Department of the Army announced a joint memorandum issuing guidance to field staff on implementation of “continuous surface connection” consistent with the U.S. Supreme Court’s May 25, 2023, decision in the case of Sackett v. Environmental Protection Agency. The agencies also announced a Federal Register notice publicizing a series of six listening sessions and a 30-day recommendations docket to solicit feedback on key aspects of the definition of “waters of the United States.”

    30 January 2025 - The U.S. Army Corps of Engineers (USACE) is announcing the availability of the draft changes to the 2024 NWPL and its web site to solicit public comments

    The U.S. Army Corps of Engineers (USACE), as part of an interagency effort with the U.S. Environmental Protection Agency, the U.S. Fish and Wildlife Service and the U.S. Department of Agriculture Natural Resources Conservation Service, is announcing the availability of the draft changes to the 2024 NWPL and its web site to solicit public comments.  The public now has the opportunity to comment on the proposed changes to wetland indicator status ratings for one plant species in the Atlantic and Gulf Coastal Plain and Eastern Mountains, and Piedmont regions and one species in the Midwest and Northcentral and Northeast regions.

    8 January 2025 - The U.S. Army Corps of Engineers and the U.S. Environmental Protection Agency Jointly Announce the Availability of the National Ordinary High Water Mark Field Delineation Manual for Rivers and Streams (National OHWM Manual)

    The U.S. Army Corps of Engineers (USACE) and the U.S. Environmental Protection Agency (EPA) jointly announce the availability of the Final National Ordinary High Water Mark Field Delineation Manual for Rivers and Streams (Final National OHWM Manual). The Final National OHWM Manual serves as a non-mandatory technical resource which can be used in appropriate situations to assist with identifying and delineating the ordinary high water mark (OHWM) of rivers and streams located throughout the Nation.

    6 January 2025 - Public Notices Module Now Available - Enhances RRS Functionality!

    The U.S. Army Corps of Engineers (USACE) is excited to announce the launch of the Public Notice module on the Regulatory Request System (RRS). Released in January 2025, this new feature allows users nationwide to search, review, and comment on projects being reviewed by the Regulatory Program, significantly enhancing transparency, accessibility, and efficiency. The Public Notice module provides access to Regulatory projects requiring a standard permit or when public notices are issued to develop Mitigation Banks, In-lieu Fee Programs or to issue/reissue a Regional or Programmatic Permit or Section 404 Letter of Permission.
