Section 1001 of the American Recovery and Reinvestment Act of 2009 expanded the HAP authority to authorize the Secretary of Defense to provide financial aid to:
1) Members of the Armed Forces (30% or greater disability) who incur a wound, injury, or illness in the line of duty during a deployment in support of the Armed Forces on or after September 11, 2001;
2) Wounded DoD and Coast Guard civilian homeowners reassigned in furtherance of medical treatment or rehabilitation or due to medical retirement in connection with a disability incurred in the performance of his or her duties during a forward deployment occurring on or after September 11, 2001 in support of the Armed Forces; and
3) Surviving spouses of fallen warriors who move within two years of the death of such employee or member.
HAP is subject to the availability of funds as appropriated by Congress to the DoD for the program and will cease when all funds are expended. The U.S. Army is the DoD Executive Agent for administering the HAP, and the U.S. Army Corps of Engineers (USACE) implements the program for the Army.
At this time, applications are only being accepted from Wounded, Injured, or Ill and Surviving Spouse applicants. Applications for benefits by members of the Armed Forces due to eligibility pursuant to 32 CFR Part 239.6 (a)(4) because of permanent reassignment (PCS) must have been submitted directly to the Savannah District by U.S. Mail or commercial delivery service, and must have been postmarked or deposited with the commercial delivery service no later than September 30, 2012. Applications for permanent reassignment can no longer be accepted. Applications of eligible personnel for benefits due to eligibility pursuant to 32 CFR Part 239.6 (a)(3) because of BRAC 2005 must have been submitted directly to the Savannah District by U.S. Mail or commercial delivery service, and must have been postmarked or deposited with the commercial delivery service no later than September 30, 2012. Applications for BRAC 2005 personnel can no longer be accepted.
